1. General conditions
    1. Goldsmith Jewellery & Diamonds e-shop sells jewellery products (hereinafter Products).

    2. The conditions are established to legal relations, which occur between the client (hereinafter as the Client) and the owner of the shopping environment OÜ Souchek (hereinafter as the Seller) located at the internet address www.goldsmith.store (hereinafter as the e-shop) in connection with the purchase of Products in the e-shop.

    3. In addition to these conditions the purchase of products in the e-shop is regulated by legal acts established in the Republic of Estonian.

    4. Seller’s data: OÜ Souchek, registry code 10939037.

  1. Prices

    1. All prices in the shop are in Euros and include the value added tax established in the Republic of Estonia.

    2. The Product price is effective from the moment the order is placed until the due payment date. If the Seller changes the Product price after the order is placed, but before the due payment date of the order, the Client undertakes to pay the price valid at the moment of placing the order.

    3. The Seller has the right to change the prices of Products sold in the shop at any time.

    4. The Seller shall not be responsible for the taxes payments and declarations (including possible customs duty and declarations) payable in the Client’s country of location.

  1. Products
    1. Products displayed in the e-shop are available in the warehouse as a rule. The delivery of the Products cannot be guaranteed as it may be subject to technical problem in the programs of the e-shop.

    2. If a Client places an order but it appears that the Product is not available in the warehouse, the e-shop is not able to deliver the order. In such a case the employee of the e-shop contacts the Client and suggests a replacement product, a possible new delivery date or returns the Client’s payment sum within 14 days at the latest.

    3. The photos of Products displayed in the e-shop are illustrative and may undeliberately differ a little from the actual appearance of the Product.

  1. Purchase procedure

    1. The Client chooses the desired Product in the e-shop and adds it in the shopping trolley by clicking on the button “Add in the shopping cart”.

    2. For the placement of the order click in the shopping cart the button “Forward to payment” after which the Client is directed to the page where the order is placed. After the required data is entered, the Client pays for the Product via the internet bank link and confirms the order by clicking the button “Back to the merchandiser”.

    3. After having paid for the Product, the e-shop sends the Client a confirmation of the placed order to the e-mail.

    4. The order is confirmed when the sum payable by the Client has been accrued on the Seller’s bank account.

    5. After the order is confirmed, the Client may receive the Product by mail or in the Seller’s jewellery shop located at Suur-Sõjamäe 4, Tallinn 11415, Estonia, Ülemiste City ground floor, jewellery shop Goldsmith.

    6. Orders not paid for by due date are be cancelled.

    7. The Client undertakes to submit necessary and true data upon placing the order.

    8. The Seller shall not be responsible for the failure to deliver the order if the Client has submitted incorrect data or due to any consequences proceeding from it.

  1. Delivery

    1. Products from the e-shop can be ordered to the address in the Republic of Estonia or abroad.

    2. The Client can choose the best delivery method when placing the order. Expenses that accompany the Product’s transport costs are covered by the Client unless provided otherwise by the Seller.

    3. The Client is obliged to keep the packaging of the Product, the price tag and the security element for 14 days till the end of the returning deadline.

    4. The Client is obliged to check the correctness of the contact data before placing the order in order to avoid delays and misunderstandings with the delivery of the Product.

    5. The Seller shall not be held responsible for the delays and misunderstandings related to the delivery of the Products if the delay or misunderstanding is caused due to incorrect or wrong data submitted by the Client when placing the order.

    6. If the package delivered to the Client by the courier is damaged or opened, the Client must immediately inform the courier or fix the damage or the act of being opened. The Client may immediately return the damaged or opened package by the courier. If the Client wants to open the damaged packaging to become familiar with the condition of the product and the necessity to return the Product, or accepts the package opened prior, then the courier and the Client prepare a written notification thereof and mark down the visible damages of the package and the Product and sign the document.

    7. The Client immediately informs the Seller about a Product which has been damaged during the delivery or an opened package by sending a corresponding e-mail to the address store@goldsmith.ee. Photos showing the damage caused to the Product and the packaging have to be added to the e-mail including the notification showing the damage caused to the package/Product signed by the Client and the courier.

    8. An international order is delivered to the courier at least by 12 o’clock (CET) on the next working day after the order is confirmed.

    9. All shipments within Estonia generally arrive at the destination specified by the purchaser within 2 -7 business days of the date of entry into force of the contract of sale. All shipments outside of Estonia are guaranteed to arrive within 7 calendar days. We have the right to ship goods in up to 45 calendar days in exceptional cases.

  1. Right of withdrawal

    1. The Client has the right to return the Product ordered from the e-shop within 14 days or exchange it for any other Product of equal value. The returning date starts from the receipt of the Product.

    2. If the price of the Product replaced by the Client is lower than the price of the Product chosen by the Client, the Seller shall issue the Client a gift card to compensate the price difference. The difference of prices is not compensated by cash or transfer.

    3. If the price of the Product exchanged by the Client is higher than the price of the Product chosen by the Client, the Client undertakes to compensate the price difference immediately.

    4. For withdrawal the Client has to send the Seller a withdrawal application established by the latter to the e-mail address return@goldsmith.ee

    5. A returned or exchanged Product is returned to the Seller the same way it is delivered to the Client or to the Seller’s jewellery shop Goldsmith at the address Suur-Sõjamäe 4, Tallinn 11415, Estonia, Ülemiste City ground floor.

    6. The Client undertakes to return the goods to the Seller within 14 days since sending the withdrawal application.

    7. The Seller returns the Client payments received pursuant to the contract within 14 days at the latest since the receipt of the withdrawal application but not before the Products have reached the Seller and the Seller is convinced that the returned Product is in conformity with all requirements.

    8. Payments received from the Client for the Product are returned to the same bank account from where the Product is paid for.

    9. If the Client has paid for the Product by a gift card, the Client shall be issued a gift card of equal value.

    10. The returned or replaced Product must not be used, damaged, stained or bear any other signs of use. Together with the Product the Client must return also the product packaging, the price tag and all items included in the product packaging. A Product is deemed as used if a safety label has been removed from the Product or the safety label has been damaged.

    11. A Product cannot be returned or exchanged if the Product is made for a special order, has been engraved by the Seller or the Product has been changed (e.g. an engraving has been added, a precious stone has been replaced, the size or the fixing has been changed).

    12. Costs related to the returning of the Product upon withdrawal from the Contract are covered by the Client unless the Seller has provided otherwise.

  1. Order for submitting claims

    1. Products purchased from the e-shop are subject to a 2-year-long claim submission period.

    2. If any disadvantage should appear the Seller has to be informed thereof within two months since the detection of the disadvantage at the latest by sending an e-mail to the address store@goldsmith.ee.

    3. If it appears that a Product purchased from the e-shop has a manufacturing defect, the Seller is obliged to replace or repair the Product. If it is not possible to replace or repair the product, the Seller shall return the Client all payments that accompany the sales contract.

    4. In case the Product is not in conformity with the contract conditions, the Seller shall cover the costs related to the repair or the replacement of the Product, including costs related to transport, posting, work, travel and materials. 

    5. If the Seller has doubts whether the disadvantage of the Product is caused by defective work or is caused by the Client, the causes of defects shall be determined by experts.

  1. Liability

    1. The Seller and the Client shall be liable in regard to the damage caused to each other in case the conditioned of use are violated in accordance with the cases and in the scope established by the legal acts established in the Republic of Estonia.

    2. The Seller shall be liable within the sales price of the Product.

    3. The Client undertakes to use the e-shop service in conformity with the legislation and on purposes compliant with good practice.

    4. The Seller shall not be liable for the damage caused due to the non-purposeful use of Products, including the delay of delivery if caused by circumstances the Seller could not have influenced/or caused by circumstances beyond his/her control (force majeure).

  1. Processing personal data

    1. The Client gives the Seller a clear and enlightened consent for processing his/her personal data.
      Personal data is data that the Seller collects in order to complete or contact the Customer with an agreement. The collection of personal data by the Client may take place in the following ways:
      – The submission of contact information (including your name, personal identification code, postal address, telephone number, e-mail address) in the e-shop;
      – Using the e-shop through the Customer’s account information or cookies;
      – When purchasing an item in the e-shop for storing information about a person’s contact information or purchasing preferences (The seller may ask for voluntary personal information on a particular web site. The required personal data may include name, address, postal code, e-mail address, telephone number and other information);
      – postpayment application.

    2. The Seller may also collect non-personal data that cannot be directly linked to one particular person (e.g. gender, age, language preference, location). The data is collected with the aim of providing the Customer with more useful information and identifying the Customers’ preferences.
    3. The personal information collected is used to inform the Customers of the Seller’s product information, campaigns and future events. A customer who does not wish to be on the newsletter list or receive notices of products of interest can be removed at any time from the target audience of the addressees. Personal data collected is also used for the delivery of goods and fulfillment of obligations entered into by the customer. For the better servicing of the Customer, the Seller may disclose information about individual Customers to a third party that provides services to the Seller and has agreed to keep the shared information confidential. The third party is, for example, a partner whose role is to transport the goods sold in the e-shop or to provide a post-paid service.
    4. The personal data the Seller becomes aware of is entered in the client register and is used for the purpose of sale- services and for offering goods to the Client.

    5. The Seller retains the Client’s contact data entered during the purchase procedure and the data about the purchased goods. This information is handled as confidential and is processed in conformity with the Personal Data Protection Act. Personal data required for sending Products to the Client is delivered to the enterprise providing courier services.

    6. The Seller may use the Client’s personal data for making special offers to the Client and providing information about campaigns by e-mail only in case the Client has given his/her agreement.

    7. The data communication between the Client and the banks and the card payment centre is encrypted to ensure the safety of the Client’s personal data and the bank data.

    8. The payment is not made in the environment of the e-shop, but in the safe payment environment of corresponding banks or service providers. The e-shop has no access to the data of the Client’s bank account or credit card.

    9. All Customer personal information received during a visit to the e-shop and purchases will be treated as confidential information.

  1. Conditions of use and changes in them

    1. The Client agrees to the conditions of use of the e-shop he/she registers or makes a purchase.

    2. The sales contract between the Seller and the Client take effect when the purchase sum is accrued on the Seller’s bank account.

    3. The Seller reserves the right to change the conditions of use of the e-shop and the prices of products without any advance notice. A notification of changes is publicised in the environment of the e-shop. The transactions are subject to the prices and other conditions visible to the Client during the performance of the transaction.

    4. The Seller has the right to waive from the execution of the order if the price displayed in the e-shop is misleading due to a technical error.

  1. Other conditions
    1. Disputes between the Client and the Seller shall be settled by negotiations. If no agreement is achieved, the Client may turn to the Consumer Disputes Committee.
